Applicable Laws

This policy is governed by the Act respecting the protection of personal information in the private sector (LPRPSP, CQLR c. P-39.1), as amended by Law 25 (L.Q. 2021, c. 25), the Real Estate Brokerage Act (CQLR c. C-73.2) and its regulations, the Civil Code of Quebec, and the federal Personal Information Protection and Electronic Documents Act (PIPEDA), as applicable.

Personal Information Collected

In the course of our real estate brokerage activities, we may collect the following personal information:

  • First and last name, phone number, email address, mailing address and postal code

This information may be collected through contact or evaluation forms, newsletter subscriptions, phone or email communications, OACIQ standardized forms, and website cookies.

Purpose of Collection

We collect only the information strictly necessary for the following purposes:

  • Carrying out real estate transactions and related brokerage services
  • Record-keeping and monitoring of professional practices by the OACIQ
  • Responding to your requests for information or property evaluations
  • Sending the newsletter or exclusive content you subscribed to
  • Improving the website experience
  • Fulfilling our legal and regulatory obligations

Important: If we wish to use your personal information for any purpose beyond the one for which it was collected, for example, to send you invitations, market updates, or promotional communications, we will ask for your separate, specific, and explicit consent at that time. You may withdraw that consent at any time.

Consent

When you engage our real estate services, we collect the personal information necessary to carry out your transaction or process your request.

This collection requires your consent, which must be free, informed, and given for specific purposes. You may withdraw your consent at any time; however, if the information is essential to completing a transaction or performing a brokerage contract already underway, withdrawal may prevent us from continuing to provide that service.

If we wish to use your information for any purpose beyond your current file, such as sending market updates, a newsletter, or promotional communications, we will request a separate and explicit consent for that specific purpose at the appropriate time.

Consent related to your use of this website (cookies, browsing data) is addressed in our Terms of Use.

Retention and Destruction

Personal information is retained only as long as necessary for the purposes for which it was collected, or as required by law. Key retention periods:

  • Transaction files: minimum 6 years following the final closing of the file, in accordance with OACIQ professional obligations
  • Newsletter subscribers: until you unsubscribe
  • Browsing data (cookies/logs): maximum 13 months

Once the applicable retention period has expired, personal information is securely destroyed or anonymized.

Communication and Disclosure

We do not sell, rent, or trade your personal information. We may share it with the following parties, strictly as required:

  • The OACIQ, its syndic or inspector, in the exercise of their legal powers
  • FARCIQ (professional liability insurer)
  • Other parties to a transaction (e.g., notary, mortgage lender, co-operating broker)
  • Law enforcement or regulatory authorities when required by law
Cookies

Our website uses cookies. Upon your first visit, you will be asked to give your explicit, prior consent. Cookies essential to the functioning of the site do not require consent.

  • Essential cookies: required for basic site functionality (no consent required)
  • Analytics cookies: used to understand how visitors use the site (consent required)
  • Marketing/preference cookies: used to remember preferences and deliver relevant content (consent required)

You may withdraw or modify your consent at any time through your browser settings.

Security

We implement appropriate technical and organizational security measures, including encryption in transit and at rest, access controls, staff training, and secure destruction procedures. We maintain a confidentiality incident management protocol.

In the event of a confidentiality incident presenting a risk of serious harm, we will notify the Commission d’accès a l’information (CAI) and the affected individuals in accordance with the law. We maintain an internal register of confidentiality incidents.

Roles and Responsabilities
